Article 1 – Scope of application.
The general terms and conditions of sale detailed below (hereinafter referred to as the "General Terms and Conditions") govern the contractual relationships between any user of the website WWW.HPCORSE.FR, EURL with a capital of €6,000, registered in the commercial register of La Roche sur Yon. (Hereinafter referred to as "HP CORSE"), the company owning the website WWW.HPCORSE.FR. These general terms and conditions of sale are the only ones applicable and replace any other conditions, except by prior, express, and written agreement. HP CORSE may occasionally modify certain provisions of its general terms and conditions (of sale, delivery, and warranty), so they should be reviewed before each visit to the website WWW.HPCORSE.FR. We consider that by confirming your order and/or purchase, you accept our general terms and conditions of sale without reservation after having read them. By accessing the site, you agree to comply with the general terms and conditions as well as the terms of use therein.
Article 2 – Placing your order and its validation.
To place an order, we provide you with three means:

- By email: contact@hpcorse.fr. This email is protected against spam bots; your browser must support JavaScript to view it.
- By post: Send the completed and printed order form along with your payment by check and a copy of your identification documents. We will notify you of its receipt via email. Products can only be delivered after the check's solvency verification period (between 10 and 15 days).
Each order requires your acceptance of the General Terms and Conditions of Sale. By checking the designated box, you fully accept these terms without reservation. Without acceptance, no order can be validated. An email confirming the order will be sent to the email address you provided. The automatic registration systems are considered proof of the nature, content, and date of the order.
HP CORSE reserves the right to refuse or cancel any order from a client, particularly in cases of insolvency, payment default, or a dispute related to the payment of a previous order.
The information provided by the client when entering their order details is their responsibility. HP CORSE cannot be held responsible for errors made by the client in the recipient's details (delivery address, billing address, email, and phone number) and the resulting delays or inability to deliver the ordered products.
Article 3 – Product availability and delivery times.
HP CORSE commits to fulfilling your order within the limits of available stock. Delivery times are generally between 24 hours and 15 days, except for specific products (windshields, wheels, certain exhaust systems, specific fairings). The average delivery time is indicated on the site for each product; if not, please contact us beforehand. Delivery times are provided for information purposes only; HP CORSE cannot be held responsible for delays (due to temporary or permanent stock shortages from suppliers, among other reasons). A delay in delivery does not constitute grounds for automatic cancellation of the order. However, we commit to minimizing these delays and offering an alternative product of equivalent value. Delivery occurs within 24 to 72 hours of the shipment date, depending on the chosen delivery method. To avoid issues during delivery, we need all necessary information: address, name, email, phone number, to contact you in case of difficulties from the delivery service. A shipment confirmation and a tracking number will be automatically sent to you.
Items benefiting from special discounts (discounts, promotions, special offers, reverse auctions, sales, etc.) are subject to stock availability. They cannot be combined with any other special offer granting a discount, except for the credit code(s) you may have.
Article 4 – Product Prices and Delivery Charges.
The selling prices displayed on the site are in euros, inclusive of all taxes, but exclude delivery charges. The delivery charges are indicated to the customer as they select products and choose the delivery method. The total amount is shown at the end of the ordering process, in addition to the price of the selected products, before the customer confirms their acceptance.
We reserve the right to modify our prices at any time but commit to applying the prices indicated on the site at the time of your order.
Please note that in the event of an incorrect price display, clearly unrealistic, for any reason (technical error, manual error, bug, etc.), the order (even validated by us) will be canceled, and we will inform you as soon as possible. You will then have the option to reorder at the corrected and accurate price or request a refund.
Delivery charges are borne by the user and are invoiced at the end of the order in addition to the selected products. Delivery costs are €8.28 (in mainland France and for standard delivery, excluding express delivery) for orders below €150. Delivery is free for orders above €150 (in mainland France and for standard delivery, excluding express delivery), except for bulky or heavy products (indicated in the product description).
Article 5 - Delivery Methods and Parcel Insurance
The delivery area corresponds to the geographical coverage of the offer (mainland France only, excluding Corsica and overseas territories).
Products are delivered to the address specified by the customer at the time of the order or to the specified pickup point.
Delivery is deemed completed as soon as HP CORSE hands over the product to the carrier.
The delivery slip provided by the carrier or the pickup point, dated and signed by the customer upon delivery, will constitute proof of transportation and delivery.
Upon delivery, the customer must check the content, compliance, and condition of the product(s). In case of damage, total or partial loss, or any other issues, it is the customer’s responsibility to immediately address the carrier without HP CORSE's liability being engaged. Therefore, HP CORSE recommends checking the condition of delivered products before signing the delivery receipt.
If anomalies are detected, the customer must refuse the delivery or issue handwritten, precise, and dated reservations.
In case of customer absence during delivery, a notice of passage will be left in the mailbox, allowing the customer to collect the package from the chosen carrier (the customer must sign a delivery receipt at the time of collection).
The standard insurance complies with the law, providing €23 per kilo. For additional ad valorem insurance up to €1,500, the customer must select this option during the purchase (2% of the product's value).
If this option is not selected, HP CORSE is not responsible for transportation, which remains at the buyer’s discretion (unless additional insurance is taken). In case of loss or theft, it is the buyer's responsibility to contact the transport company to claim any potential compensation.
Article 6 – Order Payment and Cancellation
Payment for your order can be made by credit card (secured payment via our bank platform), bank transfer, check, or PayPal (see Article 2).
For payment by check, your order will only be dispatched after receipt and bank validation of your payment.
The payment is debited immediately upon ordering. HP CORSE retains full ownership of the ordered material until it is fully paid.
In case of order cancellation due to an error on your part (product, size, color, etc.), involving a refund, it can be made by bank check, cancellation of your transaction via our bank, or in the form of a credit note for another order (less any incurred fees).
Article 7 – Product Information
The photographs illustrating the products presented on the site and the technical information are not contractual and do not constitute a commitment from HP CORSE. The technical sheets and descriptions are carefully checked by the HP CORSE team but are sourced from our partners or suppliers. HP CORSE's responsibility cannot be engaged regarding the validity of their content.
Article 8 – Right of Withdrawal, Defective Products, and Returns
In accordance with the provisions of Article L 121-20 of the French Consumer Code, you have 14 business days (instead of the seven days provided by law) to return a product that does not meet your expectations (refer to Ordinance No. 2001 of August 23, 2001, Articles 5 and 12 of the Official Journal dated August 25, 2001). Within this period, you can return the product at your expense, accompanied by your invoice. Only products in new and complete condition (accessories, packaging, manuals) returned in their original, unmarked, and unstained packaging (also in new condition) will be accepted.
This right of withdrawal does not apply to all products. Excluded items include: audio and video recordings (CDs and DVDs) and software whose packaging has been opened by the consumer, newspapers, magazines, custom-made or personalized goods, lotteries, perishable goods, and auction purchases.
Any product that has been damaged or whose original packaging has been deteriorated will not be refunded or exchanged. If the item is returned incomplete or damaged to HP CORSE, a depreciation will be applied based on the diagnosis made by the after-sales service. Software, films, and CDs can only be returned if they have not been unsealed. The above-mentioned deadlines begin from the day the order is delivered. All returns must be reported in advance to HP CORSE by email or by phone at: 02.51.07.36.89. A return number will then be assigned to the product. This right of withdrawal is exercised without penalty (except for the aforementioned depreciation), except for return and shipping costs.
In the event of exercising the right of withdrawal, the user may choose to request a refund of the amounts paid (less shipping costs) or an exchange for the product. In the case of an exchange, shipping of replacement products to the user will be at their expense. If exercising the right of withdrawal, HP CORSE will make every effort to refund the user as quickly as possible. This delay will depend on the analysis of the returned products and their condition. As a precaution, a technical inspection of the equipment is systematically carried out before any exchange or refund; this may take around ten days.
Article 9 – Compliance of products with current standards – approvals
The products sold on the HP CORSE website are exclusively reserved for competition or private use, except for the specific mention “approved product.” If the product is labeled “approved,” this means it complies with current European standards governing this type of product or with French standards. The absence of the mention “approved product” or “approved” means that this product is not approved for use on public roads.
HP CORSE cannot be held liable for improper use of purchased products or for using non-approved products on public roads or for purposes for which they are not intended, being explicitly stated that only approved products are identified as such.
The accessories offered are primarily “adaptable” accessories and therefore not original parts, except in cases of explicit clarification.
Article 10 – Evidence agreement.
The Client acknowledges the admissibility as evidence of computer records, computer statements and listings, and other electronic supports, particularly in the context of any dispute arising from a breach of these terms by either Party.
Article 11 – Liability.
HP CORSE cannot be held liable for the non-performance of the contract in case of force majeure, disruption or total or partial strike, particularly of postal services and transport or communication means, flooding, fire, or war. HP CORSE shall not be held liable for any indirect damages, loss of business, loss of profit, loss of opportunity, damage, or expenses resulting from the purchase of any product presented on the Site.
We remind you that it is wise to back up the data contained in purchased products.
HP CORSE cannot be held responsible for any loss of data, files, or more generally for any damage resulting from the user's failure to back up data contained in purchased products. HP CORSE cannot be held liable for the consequences resulting from the improper use of products sold on its Site. The total impossibility to use the products, particularly due to hardware incompatibility, cannot give rise to any compensation, refund, or liability on the part of HP CORSE. Hypertext links may redirect to other websites, and the site HP CORSE disclaims all responsibility if the content of these sites violates current legal and regulatory provisions. The liability of HP CORSE will, in any case, be limited to the amount of the order.
Article 13 – Privacy.
The information you provide is essential for processing and delivering orders, issuing invoices, and warranty contracts. Their absence will result in the cancellation of your order. By registering on the Site, you agree to provide truthful and sincere information about yourself. Providing false information is contrary to these terms and conditions and the usage policies found on the site. In accordance with the "Data Protection Act," the processing of your information has been declared to the French Data Protection Authority (CNIL). HP CORSE is authorized to collect, process, and use information about you. These data are subject to computer processing. You have a permanent right of access and rectification to all your data, in accordance with European laws and national legislation in force (Article 34 of the law of January 6, 1978). You can, at any time, request to know which information HP CORSE has about you. You can modify this data at any time upon request. HP CORSE is the sole owner of information about you. Only HP CORSE and its contractual partners may send you information as part of specific and occasional promotional operations. These partners are specially chosen by HP CORSE and are recognized for the quality of their products and services.
Article 14 – Disputes.
This contract is subject to French law. Any dispute, regardless of the place of delivery, arising from the interpretation or execution of these general terms and conditions will be submitted to the competent courts within the jurisdiction of the Court of Appeal of La Roche-sur-Yon.
Article 15 – Customer reviews.
All reviews submitted by users of HP CORSE are read and checked before being published. Only reviews regarding products will be accepted and consequently visible on the site. Customer reviews therefore only concern the items.
